These Terms and Conditions govern the selling terms of all orders placed by customer(s) (hereinafter referred to as "you" or "the Customer") on the domain bohomoon.com or any sub-domains, from the moment you place an order until payment and delivery. By ordering a product, you agree to be legally bound by these Terms and Conditions. Please ensure you have read and understood them before placing an order.

Bohomoon Ltd reserves the right to amend these Terms and Conditions at any time. The updated version will not be retroactive and the Parties shall only be bound by the Terms and Conditions which are published online at the time the order is placed. 

2. CONCLUSION OF CONTRACT

By placing an order on the Site, you are offered to purchase products subject to these Terms and Conditions. On the Site, you will follow the below steps in completing your order:

  • Find the product(s) you wish to purchase on the Site.
  • Select your required size and click 'Add to Cart'.
  • After adding all desired items to your cart, select 'Checkout'.
  • You will be required to input your shipping and billing information.
  • Review your order to ensure all items, details and shipping methods are correct.
  • Click 'Pay Now'.
  • You will receive confirmation of your order via email, which will be delivered to the email address provided at the time of ordering.

In the unlikely circumstance that Bohomoon Ltd cannot fulfil your order for any reason, an email will be sent promptly to the email address provided at the time of ordering, explaining the situation and all possible solutions.

Please check the contents of your cart and your delivery information to ensure your order is correct before pressing 'Pay Now', as Bohomoon Ltd may be unable to amend or cancel your order once submitted. If you have entered any incorrect information at checkout, please follow the instructions on your order confirmation email as you have 30 minutes from placing your order to amend or cancel before it is passed to our warehouse for processing.

Bohomoon Ltd reserves the right to reject or cancel the fulfilment of any and all orders placed on the Site. We explicitly reserve the right to not accept your order for any of the following reasons:

  • The product is not available ('out of stock').
  • Your billing information is not correct or not verifiable.
  • Your order has been suspected of fraudulent activity.
  • Our couriers were unable to deliver to the shipping address provided at checkout.
  • Force Majeure.
  • In the event of misspelling, errors in pricing or other errors in the information provided on the Site.

3. PRICING AND PAYMENT

The product prices displayed on the Site are inclusive of Valued Added Tax (VAT). Shipping rates are applied per order. The exact shipping rate applied to your order will depend on the delivery location.

Bohomoon Ltd has the right to change or update information at any time, without warning, including errors with prices, details and descriptions which may appear on the Site.

The payment methods available to you are as follows:

All payments are subject to validation checks and authorisation by your chosen payment service provider. If the provider refuses to, or cannot for any reason, authorise payment, you will be notified by email during the checkout process.

4. PRICING VARIATIONS

Conversion rates may apply to prices across destination-specific stores on the Site.

Bohomoon Ltd reserves the right to change the price of a product at any time, without warning. Any orders placed prior to this change cannot be amended to the revised price.

5. SHIPPING AND DELIVERY

5.1
All orders made on the Site are dispatched from the UK by Royal Mail or InPost. Internationally, our couriers are Fedex. We aim to dispatch all orders within one working day; however, due to demand, this is not always possible. A tracking number, if applicable, will be included in your shipping confirmation email, which you will receive a short while after you receive your order confirmation email.

Depending on the delivery address provided by the Customer, there will be various delivery options available – these can be found at https://www.bohomoon.com/pages/shipping. The shipping fee will depend on the delivery option you select. All available shipping methods will be displayed to you during the checkout process.

Free delivery is applicable to orders over the specified cart value as declared on the Shipping page of the Site. If free delivery is applicable, your order will be dispatched with Standard Delivery unless Express is selected and paid for.

5.5
We will carry out a pre-authorisation check on the card used for purchase to ensure there are sufficient funds to complete the transaction. The product you have purchased will not be dispatched until this verification has been completed and payment has been successfully taken.

5.6
Bohomoon Ltd cannot be held accountable for parcels delayed for reasons beyond our control. These reasons include but are not limited to the following: customs, service strikes, civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, weather, natural disasters, fire, epidemics or failure of public or private telecommunications networks.

5.7
Upon confirmation of your order, and receipt of the package by the delivery company, you may receive an email containing an estimated delivery date and time from the courier – this service is offered only if delivered via InPost. If an event outside of our control happens, including those listed at clause 5.6 above, and affects the estimated date of delivery, the couriers will provide you with a revised estimated date of delivery.

Our couriers do not carry out deliveries during Sundays or public holidays. However click and collect options are available 7 days a week.

5.9
Unless you and we agree otherwise, if we cannot deliver your goods within 30 days of the date of confirmation of your purchase, we will:

  • Let you know;
  • Cancel your order; and
  • Give you a refund. 

5.10
You are responsible for the goods once they have been delivered to the address specified by you when you placed your order with us. In other words, the risk in the goods passes to you when you take, or a third party nominated by you takes, possession of the goods.

6. CUSTOMS

6.1
We cover customs fees on all orders under €150 within the European Union. Countries outside of the European Union may be subject to additional duties to be paid. As the recipient, you are liable for all import duties, customs and local sales taxes levied by your country of residence; payment is necessary to release your order from customs. For orders placed on us.bohomoon.com and which are bound for the USA, tariffs will be calculated at checkout.

6.2
If you refuse to pay the duties to release your order, your order may be abandoned by the courier and made non-refundable. Bohomoon Ltd will make every reasonable effort to ensure the parcel can be shipped back to the warehouse and refunded. Shipping and handling fees may, in this case, be applied to the Customer.

6.3
Bohomoon Ltd is required by law to state the correct amount paid for any outgoing international package. Any requests to change or modify this information will be denied.

7. RIGHT OF WITHDRAWAL, RETURNS AND REFUNDS

7.1
You have the right to cancel and return your item(s) within 14 days of receiving them. You then have another 14 days to send it back. We'll process your refund within 14 days of receiving the returned item. A £2.99 return shipping fee will be deducted from your refund. Returns are accepted as long as the product is in its original condition, with all labels and tags still attached. We can't accept returns on any earrings purchased from us, even if the packaging hasn’t been opened. This is to protect the safety of our staff and customers.

7.2
You have the right to request an exchange for your returned items in lieu of a refund. Exchanges will be granted providing the exchanged item has the same full-price value as the item originally purchased.

7.3
When your return parcel reaches the warehouse and has been inspected and accepted, your refund will be issued. We endeavour to complete returns within a maximum of 7 working days (Monday-Friday). Please allow a further 7 working days for your refund to arrive back to your original payment method.

7.4
Refunds may only be made to the same payment method used to place the order.

8. PROMOTIONS AND OFFERS

8.1
When a Gift Card is issued, the card becomes the Customer's property. Gift Cards cannot be used in the purchase of another Gift Card. Gift Cards are excluded from all sales and discounts. Gift Cards are digital only. No physical card will be posted.

8.2
One discount code can be used per order. Bohomoon Ltd reserves the right to refuse or cancel the use of a discount code at any time, without warning or further discussion.

8.3
Promotions may vary across stores.

8.4
Discount codes are only applied when a correct code is entered at checkout.

8.5
Discount codes cannot be used in conjunction with any other discount code or offer, and are valid on full-price items only – unless stated otherwise in additional promotion terms and conditions.

8.6
Offers and discounts cannot be applied to orders placed outside of the promotional period, nor can discount codes be backdated.

All items are subject to availability at the time the order is placed.

9. LIFETIME GUARANTEE

9.1
Effective from 1st May 2024, Bohomoon Ltd offers a Lifetime Guarantee on all jewellery purchased on or after this date.

This guarantee covers tarnishing or discolouration of your jewellery under normal wear and care. In the unlikely event that your item tarnishes or discolours, we will replace it free of charge.

What’s Covered

  • Discolouration or tarnishing of jewellery due to normal use.
  • All items purchased on or after 1st May 2024.

What’s Not Covered

  • Items purchased before 1st May 2024.
  • Manufacturing faults (covered separately below).
  • Damage caused by misuse, modification, or unreasonable wear and tear.

Conditions of Use

Bohomoon jewellery is designed to be worn daily and is safe to use in the shower, bath, pool, and ocean. It can also be worn while using hand sanitiser, perfume, and lotions. However, the guarantee does not apply where items have been deliberately damaged or altered.

To make a claim under the Lifetime Guarantee, please contact our Customer Service team with proof of purchase and a description of the issue.

9.2
One-Year Manufacturing Warranty
All Bohomoon products are also covered by a One-Year Manufacturing Warranty from the date of purchase. This warranty covers manufacturing defects only, such as:
●    Broken chains or clasps
●    Missing stones
●    Faulty fastenings
●    This warranty does not cover:
●    Tarnishing (covered under the Lifetime Colour Guarantee)
●    Damage due to misuse or accidental breakage
●    Normal wear and tear
To make a claim under the Manufacturing Warranty, please contact our Customer Service team with proof of purchase and a description of the issue.

9.3
Nothing in this contract affects your legal rights if the goods are faulty. You may also have other rights in law. 

10. NATURE OF THE GOODS

10.1
You have certain legal rights in relation to the nature of goods (also known as ‘statutory rights’). The goods that we provide to you must be as described, fit for purpose and of satisfactory quality.

10.2
We are under a legal duty to supply you with goods that are in conformity with this contract.

10.3
The packaging of the goods may be different from that shown on the site.

10.4
While we try to make sure that:

  • All weights, sizes and measurements set out on the site are as accurate as possible, there may be a small tolerance in such weights, sizes and measurements in the goods; and
  • The colours of our goods are displayed accurately on the site, the actual colours that you see on your device may vary depending on the device you use.

We take all complaints seriously and endeavour to resolve disputes as soon as they arise. Customers wishing to make a complaint are encouraged to visit the Contact Us page and contact a member of the team at their earliest convenience.

13. INTELLECTUAL PROPERTY RIGHTS

13.1
Bohomoon Ltd owns all intellectual property rights on the Site and the material published on it. These works are protected by copyright laws worldwide.

13.2
Permission is granted to temporarily download one copy of the materials (information or software) on Bohomoon Ltd's Site for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not: modify or copy the materials, use the materials for any commercial purpose, or for any public display (commercial or non-commercial), attempt to decompile or reverse-engineer any software contained on the Site, remove any copyright or other proprietary notations from the material, or transfer the material to another person or 'mirror' the material on any other server. This license shall automatically terminate if you violate any of these restrictions and may be terminated by Bohomoon Limited at any time. Upon terminating your viewing of this material or upon the termination of this license, you must destroy any downloaded material in your possession, whether in electronic, printed, or any other format.

14. LIMITATION ON OUR LIABILITY

14.1
Except for any legal responsibility that we cannot exclude in law (such as for death or personal injury) or arising under applicable laws relating to the protection of your personal information, we are not legally responsible for any:

  • losses that were not foreseeable to you and us when the contract was formed;
  • losses that were not caused by any breach on our part;
  • business losses; or
  • losses to non-consumers.

15. DISPUTES

15.1
We will try to resolve any disputes with you quickly and efficiently. If you are unhappy with the goods you ordered, our service to you or any other matter, please contact us as soon as possible using the contact details set out at the top of this page.

15.2
The laws of England and Wales apply to this contract, although if you are resident elsewhere you will retain the benefit of any mandatory protections given to you by the laws of that country.

15.3
Any disputes will be subject to the non-exclusive jurisdiction of the courts of England and Wales. This means that you can choose whether to bring a claim in the courts of England and Wales or in the courts of another part of the UK in which you live.

16. THIRD PARTIES

16.1
No one other than a party to this contract has any right to enforce any term of this contract.

16.2
We will do all that we reasonably can to ensure that all of the information you give us when paying for the goods is secure by using an encrypted secure payment mechanism. However, in the absence of negligence on our part, any failure by us to comply with this contract or our Privacy Policy (see clause 12) or breach by us of our duties under applicable laws, we will not be legally responsible to you for any loss that you may suffer if a third party gains unauthorised access to any information that you give us. 

17. PAYING WITH KLARNA

17.1
In cooperation with Klarna Bank AB (publ), Sveavägen 46, 111 34 Stockholm, Sweden, we offer alternative payment options. Payment is to be made to Klarna with 'Pay Later'. 18. PAYING WITH CLEARPAY

Bohomoon 1 Million Orders Competition

1. The prize draws are open to UK ONLY residents aged 18 years or over.        

2. Unfortunately, you cannot enter the prize draw if you are an employee or the relative of an employee of Bohomoon Ltd or any third party directly associated with Bohomoon or administration of the prize draw.       

3. There are two ways to enter the competition, as listed below. No purchase is necessary:

Via our social media platform, Instagram. To enter via Instagram, you will need to follow @bohomoon, as well as Like the competition post, and comment ‘1MILLION’ on the same post (posted 04.07.25). Please note: Instagram is not affiliated with the competition. 

Via our website or app, you will need to sign up via the competition link (this will be shared on our @bohomoon Instagram bio, social media channels, email and available on our website / app). The link will be live throughout the campaign's duration.  

4. The Prize Draw will begin on Friday the 4th of July at 4.30pm and close on Thursday 31st of July at 11.59 pm. Any entries outside of this timeframe will not be counted. 

5. Bohomoon does not accept any responsibility for entries not successfully completed due to a technical fault of any kind.

11. The prize for the winner is non-exchangeable, non-transferable and no cash alternative is offered. We reserve the right to replace the prize with an alternative prize of equal or higher value.

13. Our decision regarding any aspect of the prize draw is final and binding and no correspondence will be entered into about it.       

14. Bohomoon accepts no responsibility for any import fees or taxes incurred by receipt of the prize associated with the giveaway.     

15. By law, we must either publish or make available information that indicates that a valid winner has been awarded. To comply with this obligation, we will send the surname and county of prize winners, to anyone who emails customerservice@bohomoon.com within one month after the closing date. If you object to any or all your surname or county being published or made available, please contact us at customerservice@bohomoon.com in such circumstances, we must still provide the information and winning entry to the Advertising Standards Authority if they ask us to do so.          

16. You are deemed to have accepted and agreed to be bound by these terms and conditions upon entry. We reserve the right to refuse entry or award any prize to anyone in breach of these terms and conditions.  

17. We can void, cancel, suspend, or amend the promotion where it becomes necessary to do so.  

18. These terms and conditions and this promotion are governed by English law. If any entrants to this promotion wish to take court proceedings, then they must do this within the courts in the United Kingdom.
